MEDIRA GmbH takes the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the statutory data protection regulations and this data protection declaration.

As a rule, it is possible to use our website without providing personal data. Cookies

In order to make visiting our website more attractive and to enable the use of certain functions, we use so-called cookies on various pages. Contact form

If you send us inquiries via contact form, your data from the inquiry form including the contact data you provided there will be stored by us for the purpose of processing the inquiry and in case of follow-up questions. We do not pass on this data without your consent.

The processing of the data entered in the contact form is therefore based exclusively on your consent (Art. 6 para. 1 lit. a DSGVO). You can revoke this consent at any time.

For this purpose, an informal communication by e-mail to us is sufficient. The legality of the data processing operations carried out until the revocation remains unaffected by the revocation.

The data you entered in the contact form will remain with us until you request us to delete it, revoke your consent to store it, or the purpose for storing the data no longer applies (e.g. after we have completed processing your request). Mandatory legal provisions - in particular retention periods - remain unaffected.

Inquiry by e-mail, telephone or fax

If you contact us by e-mail, telephone or fax, your inquiry including all resulting personal data (name, inquiry) will be stored and processed by us for the purpose of processing your request. We do not pass on this data without your consent.

The processing of this data is based on Art. 6 (1) lit. b DSGVO, if your request is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on your consent (Art. 6 (1) (a) DSGVO) and / or on our legitimate interests (Art. 6 (1) (f) DSGVO), as we have a legitimate interest in the effective processing of requests sent to us.

The data you send to us via contact requests will remain with us until you request us to delete it, revoke your consent to store it, or the purpose for storing the data no longer applies (e.g. after we have completed processing your request). Mandatory legal provisions - in particular legal retention periods - remain unaffected.

Applications

We offer you the opportunity to apply to us (e.g. by e-mail, by post or via an online application form). In the following, we inform you about the scope, purpose and use of your personal data collected during the application process. We assure you that the collection, processing and use of your data will be carried out in accordance with applicable data protection law and all other statutory provisions and that your data will be treated in strict confidence.

Scope and purpose of data collection

When you send us an application, we process your associated personal data (e.g. contact and communication data, application documents, notes taken during interviews, etc.) to the extent necessary to decide whether to establish an employment relationship. The legal basis for this is § 26 BDSG-neu under German law (initiation of an employment relationship), Art. 6 para. 1 lit. b DSGVO (general contract initiation) and - if you have given your consent - Art. 6 para. 1 lit. a DSGVO. The consent can be revoked at any time. Your personal data will only be passed on within our company to persons involved in processing your application.

If the application is successful, the data you submitted will be stored in our data processing systems on the basis of Section 26 BDSG-neu and Art. 6 (1) lit. b DSGVO for the purpose of implementing the employment relationship.

Retention period of the data

If we are unable to make you a job offer, you reject a job offer, withdraw your application, revoke your consent to data processing or request us to delete the data, the data you have submitted, including any remaining physical application documents, will be stored or retained (retention period) for a maximum of 6 months after the conclusion of the application process in order to be able to trace the details of the application process in the event of discrepancies (Art. 6 para. 1 lit. f DSGVO).

YOU MAY OBJECT TO THIS STORAGE IF YOU HAVE LEGITIMATE INTERESTS THAT OUTWEIGH OUR INTERESTS.

After expiration of the retention period, the data will be deleted unless there is a legal obligation to retain the data or another legal reason for further storage. If it is evident that it will be necessary to retain your data after the retention period has expired (e.g. due to an impending or pending legal dispute), the data will not be deleted until it has become irrelevant. Other statutory retention obligations remain unaffected.

Data processing for order processing

In order to process your order, we work together with service providers who support us in whole or in part in the execution of concluded contracts. If you commission us to provide a service or to send you goods, your personal data will only be used without your separate consent to the extent necessary for the provision of the service or the execution of the contract. This includes, in particular, the transfer of your data to transport companies, credit companies or other service providers used to provide the service or execute the contract.

The personal data collected by us will be passed on, for example, to the transport company commissioned with the delivery as part of the contract processing, insofar as this is necessary for the delivery of the goods. We pass on your payment data to the commissioned credit institution within the framework of payment processing, insofar as this is necessary for payment processing. The legal basis for the transfer of data is here Art. 6 para. 1 lit. b DSGVO.

We disclose customer accounts and personal data about customers if we are legally obliged to do so or if such disclosure is necessary to enforce our general terms and conditions or other agreements or to protect our rights and the rights of our customers and those of third parties.

Rights of the data subject

The applicable data protection law grants you comprehensive data subject rights (rights of access and intervention) vis-à-vis the controller with regard to the processing of your personal data, which we inform you about below:

Right to information pursuant to Art. 15 DSGVO: In particular, you have a right to information about your personal data processed by us, the processing purposes, the categories of personal data processed, the recipients or categories of recipients to whom your data have been or will be disclosed, the planned storage period and/or the criteria for determining the storage period, the existence of a right to rectification, erasure, restriction of processing, objection to processing, complaint to a supervisory authority, the origin of your data if it has not been collected from you by us, the existence of automated decision-making, including profiling, and, if applicable, meaningful information about the logic involved and the scope and intended effects of such processing that concern you, as well as your right to be informed about what guarantees exist in accordance with Art. 46 DSGVO when your data is transferred to third countries;
Right to rectification pursuant to Art. 16 DSGVO: You have the right to have any inaccurate data relating to you corrected without delay and/or to have any incomplete data stored by us completed;
Right to deletion pursuant to Art. 17 DSGVO: You have the right to request the deletion of your personal data if the conditions of Art. 17 (1) DSGVO are met. However, this right does not exist in particular if the processing is necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the assertion, exercise or defense of legal claims;
Right to restriction of processing pursuant to Art. 18 GDPR: You have the right to request the restriction of the processing of your personal data as long as the accuracy of your data, which you dispute, is being verified; if you refuse the erasure of your data due to unlawful data processing and instead request the restriction of the processing of your data; if you require your data for the assertion, exercise or defense of legal claims after we no longer need this data after the purpose has been achieved; or if you have lodged an objection for reasons relating to your particular situation as long as it has not yet been determined whether our legitimate grounds prevail;
Right to information in accordance with Art. 19 DSGVO: If you have asserted the right to rectification, erasure or restriction of processing against the controller, the controller is obliged to notify all recipients to whom the personal data concerning you has been disclosed of this rectification or erasure of the data or restriction of processing, unless this proves impossible or involves a disproportionate effort. You have the right to be informed about these recipients.
Right to data portability pursuant to Art. 20 DSGVO: You have the right to receive your personal data that you have provided to us in a structured, common and machine-readable format or to request that it be transferred to another controller, insofar as this is technically feasible;
Right to revoke consent given in accordance with Art. 7 (3) DSGVO: You have the right to revoke consent to the processing of data once given at any time with effect for the future. In the event of revocation, we will delete the data concerned without delay, unless further processing can be based on a legal basis for processing without consent. The revocation of consent does not affect the lawfulness of the processing carried out on the basis of the consent until the revocation;
Right to lodge a complaint pursuant to Art. 77 GDPR: If you consider that the processing of personal data concerning you infringes the GDPR, you have - without prejudice to any other administrative or judicial remedy - the right to lodge a complaint with a supervisory authority, in particular in the Member State of your residence, workplace or the place of the alleged infringement.

SSL encryption

This site uses SSL encryption for security reasons and to protect the transmission of confidential content, such as requests that you send to us as site operator. You can recognize an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line. If SSL encryption is activated, the data you transmit to us cannot be read by third parties.

Right to information, deletion, blocking

You have the right at any time to free information about your stored personal data, their origin and recipient and the purpose of data processing, as well as the right to correct, block or delete this data. Data security

We maintain a wide range of security measures within the meaning of Art. 32 DSGVO (technical and organizational measures) to protect your personal data. If you contact us by e-mail, we would like to point out that the confidentiality of the transmitted information is not guaranteed. The content of the e-mails may be viewed by third parties under certain circumstances. We therefore recommend that you send us confidential information by post.

Objection to advertising e-mails

We hereby object to the use of contact data published within the framework of the legal obligation to send advertising and information material that has not been expressly requested. If you exercise your right to object, we will stop processing the data concerned for direct marketing purposes.

Duration of storage of personal data

The duration of the storage of personal data is measured on the basis of the respective statutory retention period (e.g. retention periods under commercial and tax law). After expiry of the period, the corresponding data is routinely deleted, provided that it is no longer required for contract fulfillment or contract initiation and/or there is no continued legitimate interest on our part in storing it.
